Expired ITV in Spain - Fines, Insurance and Quick Help

No Grace Period in Spain

Anyone coming from Germany will be familiar with this: the TUV has expired but you carry on driving for a few more weeks. In Germany there is no immediate fine - a penalty only kicks in after 2 months of overdue inspection.

In Spain it works completely differently. There is no grace period. From the very first day after your ITV sticker expires, driving is illegal. The police can pull you over immediately and issue a fine.

This catches many German expats off guard, as they don't take the inspection deadline as seriously. Make sure you are well informed about the regular ITV inspection and its deadlines. In Mallorca the Guardia Civil and the Policía Local check regularly, especially on main roads and at routine controls.

Important: No Comparison with the German TUV

In Spain there is no such thing as being "overdue". Expired ITV = immediate fine. Plan your ITV appointment in good time, at least 2 weeks before expiry.

How Is the Fine Issued?

At a traffic stop the police check the ITV sticker on your windscreen and the vehicle registration document. If the ITV has expired, a denuncia (penalty notice) is issued on the spot.

You receive the notice directly at the roadside or by post. Within 20 days you can pay half the amount (Pronto Pago). After that the full amount is due.

Points on Your Licence?

An expired ITV does not normally lead to points on your driving licence. It is an administrative penalty (multa administrativa), not a serious traffic offence.

Tip: Use the Early Payment Discount

Pay the fine within 20 days and you save 50%. Payment is possible online via the DGT website or at any bank.

Immobilisation and Towing

When Is the Vehicle Immobilised?

In serious cases the police can inmovilizar (immobilise) the vehicle:

  • ITV expired for several months
  • Clearly visible serious technical defects (e.g. failed brakes, missing lighting)
  • Repeat offence - you were already stopped once for an expired ITV
  • No valid proof of insurance available

What Does Immobilisation Mean?

  • The police attach a sticker (precinto) to the vehicle
  • You are not allowed to move the vehicle, not even to a garage
  • It must be taken by tow truck to the ITV station or a garage
  • Towing costs: 80 to 150 EUR depending on the distance
  • Storage fees (if impounded): 15 to 30 EUR per day

How Is the Immobilisation Lifted?

You must pass the ITV and present proof to the police. Only then will the precinto sticker be removed and you will be allowed to drive again.

Insurance Coverage with Expired ITV

This is the biggest risk that many people underestimate: if you have an accident with an expired ITV, your insurance cover may be at risk.

Third-party Liability Insurance (Seguro obligatorio)

Third-party liability insurance will in principle cover the other party's damage, even if your ITV has expired. Make sure your car insurance is always up to date. The insurer has a duty to pay towards third parties.

However: The insurance company can seek recourse against you. This means it pays the other party's damage but then claims the money back from you - especially if the accident was caused by a technical defect.

Comprehensive Insurance (Seguro a todo riesgo)

The picture is worse with comprehensive insurance. The insurer can argue that:

  • You breached your duty of care (keeping the vehicle roadworthy)
  • The damage would not have occurred if the ITV had been passed (e.g. brake failure)
  • Reduced payment or full refusal are both possible

Conclusion on Insurance

An expired ITV is not an automatic exclusion from insurance, but it is a significant risk. In the worst case you are left paying the repair costs for your own car and must also cover the other party's damages.

Warning: Do Not Risk Your Insurance Cover

In the worst case, an accident with an expired ITV can lead to your insurer reclaiming the full amount of the damage from you. This can quickly run into five figures. The 42 EUR for an ITV inspection is negligible by comparison.

Getting an ITV Appointment Quickly

Your ITV has expired and you urgently need an appointment? Here is what to do.

Online Booking

  1. Go to itv.mallorca.es (or phone the central number 871 57 55 44)
  2. Select your preferred station (Calvia is usually the fastest)
  3. Check available slots - there are sometimes short-notice openings
  4. Book the earliest available appointment

Waiting Times in Mallorca (2026)

Since the 2025 overhaul of the ITV system, routine inspections are much faster than they used to be. The good news for an expired ITV: you can often get a slot within days.

Palma I (Son Castello) has been closed since December 2025. During peak season (May to July) slots fill up faster, so book as early as you can.

Tips for Faster Appointments

  • Choose Calvia or Palma II for a routine inspection rather than Inca or Manacor
  • Check online early in the morning - cancelled slots are released early
  • Use the mobile ITV: the operator now runs mobile inspections in more than 40 municipalities
  • Ask a garage: some garages can help arrange appointments faster

Also new in 2026: the V-16 light

Since 1 January 2026 the connected V-16 warning light (DGT 3.0) is mandatory and replaces the warning triangle. If you are sorting out your ITV anyway, make sure you have a compliant V-16 in the car, as a missing one is its own fine.

What to Do Until Your Appointment

If your ITV has expired and the next appointment is two weeks away:

  • Drive as little as possible - every journey carries a risk
  • Avoid main roads and areas with frequent police checks
  • Keep proof of your booked appointment in the car. Some officers show leniency if you can prove an appointment is booked - though legally it makes no difference

Tip: Book Your ITV Appointment in Good Time

You can book your ITV appointment weeks before the expiry date and have the inspection done early. The new validity period then starts from the inspection date, so you don't "lose" any time. Book ideally 4 to 6 weeks before expiry.

What to Do if You Get Caught

At a Police Stop

  1. Stay calm - it is a minor offence, not a crime
  2. Show your documents: driving licence, vehicle registration, proof of insurance
  3. Accept the penalty notice without arguing - it won't change anything
  4. Use the early payment discount within 20 days (50% off)

Contesting the Fine?

You can theoretically contest a fine (Recurso de Alzada), but with a clearly expired ITV there is virtually no chance of success. Save yourself the time and money and pay with the early payment discount.
