Building a fence or wall on Mallorca is rarely as simple as it looks when you see finished boundaries around fincas in the countryside. Almost every enclosure needs a permit from the town hall, and which procedure applies depends heavily on whether your plot is classified as building land or as rural land. There are also plenty of blanket claims online about allowed heights that simply do not apply to the island. This post explains which permit your fence or wall needs, who decides on height and material, and what wire mesh, masonry, and dry stone walls realistically cost.

A building permit for enclosures (licencia de obra para cierre de terrenos) is the official permission from the town hall for a fence, wall, or gate around a plot. In the Balearics it applies whenever the plot is not a fully serviced building plot (solar).

At a glance

For a new fence or wall, almost every municipality on Mallorca requires a permit, usually a Licencia de Obra, sometimes the faster Comunicación Previa. Height and material are not set by the Consell de Mallorca but by your municipality's zoning plan. Only repairing an existing dry stone wall using the original dry-stacking method is exempt from a permit. Budget 15 to over 100 EUR per linear meter, depending on the material.

Which permit do you need for a fence or wall?

The legal basis is the Ley 12/2017 de urbanismo de las Illes Balears, known as LUIB. Article 146.1.j) explicitly names cierre de terrenos, meaning the enclosure of a plot, as a project that requires a Licencia de Obra, unless the plot has the legal status of a fully serviced building plot (solar). In practice this covers almost every finca and most residential plots.

For technically simple work of limited scope, Article 148 LUIB provides for the Comunicación Previa, a faster notification procedure instead of a full permit. Whether a small garden wall or a low fence falls under this is decided by each individual municipality, and in some cases the Consell de Mallorca handles the procedure on their behalf. Ask your municipality's urban planning office (Urbanismo) before you build, so you know which procedure applies to your project. The principle is similar to building a pool on Mallorca: there too, it is not the size alone but the classification of the plot that decides which procedure applies.

To apply for a Licencia de Obra you will usually need:

  • Proof of ownership and the cadastral reference of the plot
  • A site sketch or simple plan showing the height, length, and material of the planned enclosure
  • The completed municipal forms plus proof of payment of the Tasa (fee)
  • For plots on rural land, often a short justification of how the project fits into the landscape

There is one exception for pure repairs to an existing dry stone wall, a Paret Seca, built in the original dry-stacking method without mortar: for that you need neither a Licencia nor a Comunicación Previa, regardless of the type of plot. If you build a new wall, or rebuild it with mortar or concrete, this exception no longer applies. On protected rural land (suelo rústico protegido) and for buildings with heritage protection (BIC), the simplified Comunicación Previa is not available at all, so you always need the full Licencia there.

Warning: building without a permit does not pay off

Municipalities on Mallorca regularly review aerial photos and orthophotos. A fence or wall built without a permit tends to get noticed, even years later. Our post on illegal construction on Mallorca explains how legalizing a build after the fact works for other projects, and where its limits are.

Why the municipality sets height and material

Fixed figures like 1.80 meters total height or a 60 centimeter base height circulate online as a supposed Mallorca rule. That is not accurate. Neither the LUIB nor the Consell de Mallorca sets a single height for fences or walls across the island. What matters is your municipality's zoning plan, the PGOU or the Normas Subsidiarias, which lays out height, base height, allowed material, and whether the upper part has to be see-through. You can view these plans through the Balearic planning portal MUIB, but your municipality's own guidance is always the binding one.

In many municipalities it is common to have a lower, partly open boundary toward the street and a slightly higher, solid boundary toward the neighbor. That is common practice, not a rule that applies across all of Mallorca. A quick call or email to the Urbanismo office before you plan can save you an expensive correction after construction.

Building land vs. rural land

On regular building land in residential areas (suelo urbano), height and setback follow the applicable zoning plan, often based on the building line of the neighboring plots. On rural land (suelo rústico), additional restrictions apply, especially in protected zones such as rural land with landscape value. Your plot's classification is listed in your municipality's land use plan and in the island planning plan of the Consell de Mallorca. Large, fully solid enclosures are approved less often there, because they change the open character of the landscape.

For hedges and trees, which are often planted alongside a fence, the Spanish Código Civil applies regardless of the zoning plan. Under Article 591, a tree that can grow taller than 2 meters must stand at least 2 meters from the property line, while 50 centimeters is enough for low shrubs, unless your municipality sets a different distance. For more on disputes with neighbors, from hedges to shared walls, see our guide to neighbor law.

What does a fence or wall cost on Mallorca?

Costs depend heavily on material, length, and terrain. As a rough guide per linear meter:

PostenKostenDauer
Wire mesh or chain-link fence15-30 €per linear meter
Wrought iron fence with base60-120 €per linear meter
Masonry wall, plastered70-110 €per linear meter
Dry stone wall (Paret Seca)90-150 €per linear meter
Comunicación Previa fee50-200 €one-time

On top of that, a full Licencia de Obra adds the ICIO, the tax on construction work, whose rate each municipality sets in its own tax code. For small enclosures the combined fee from the Tasa and ICIO usually stays in the low three figures; for bigger wall projects with an architect's project it can be noticeably more. The Comunicación Previa is typically processed within one to two weeks, while a full Licencia can take several months depending on the municipality.

Tip: price quotes with the permit included

Ask the construction company or contractor to confirm in writing whether handling the permit is included in the quote. Knowing the Tasa and any architect's fees in advance avoids expensive surprises after construction starts.

What happens if you build without a permit?

The consequences range from a fine based on the value of the construction work to an order to tear the enclosure back down. On protected rural land, legalizing it after the fact is often not possible at all, because the stricter rules apply retroactively there too. A special case is a wall at risk of collapse: under Article 389 of the Código Civil, the owner must have it torn down or secured. If nothing happens, the municipality can step in itself and bill the owner for the cost.

Do I need a permit for a low fence without a foundation?

It depends on the municipality. A light, movable fence without fixed foundations falls under the Comunicación Previa in some municipalities, or needs no permit at all. As soon as digging or concreting is involved, you usually need the full Licencia. When in doubt, ask your municipality in writing beforehand.

Can I just repair the existing dry stone wall on my finca?

Yes, as long as you restore it using the original dry-stacking method without mortar. This repair is exempt from both the Licencia and the Comunicación Previa, regardless of the type of plot. If you rebuild the wall from scratch, or use mortar, you need a permit again.

Conclusion

A fence or wall on Mallorca is almost never permit-free, the only exception is repairing an existing dry stone wall using the traditional method. Which procedure applies, the full Licencia de Obra or the faster Comunicación Previa, and how high or from what material you are allowed to build, is ultimately decided by your municipality, not by a single rule for all of Mallorca. Plan for the cost of material, the permit, and, for bigger projects, an architect's project from the start. That way the enclosure stays a project for your garden, not a dispute with the town hall or your neighbor.
