Building a Pool on Mallorca: Permits and Costs

Building a pool on Mallorca: for many owners it is the logical next step after buying a house. But contrary to what many people assume, a pool on the island is never permit-free, and on rural land strict maximum sizes have applied since 2020. In this post you will learn how the permit process works, which rules apply on building land and on Suelo Rústico, what the three common construction methods realistically cost, and what ongoing running costs you need to budget for once the pool is finished.

A pool on Mallorca always needs a building licence from the municipality. On rural land, new pools have been limited to 35 m² of water surface and 60 m³ of volume since 2020. For the construction itself, plan on 15,000 to over 60,000 EUR depending on the method, plus around 4 to 6 percent of the construction sum for permits and taxes.
Which permit do you need to build a pool?
The Licencia de Obra is the urban planning permit issued by the Spanish municipality. It confirms that a construction project complies with the applicable zoning plan, and it must be in place before work begins. A pool counts as a built structure, not as garden furniture: it permanently alters the plot and is therefore classified as an Obra Mayor, a major construction project, in practically every municipality on Mallorca.
For the application you will usually need:
- A technical project (Proyecto), drawn up by an architect or Aparejador (quantity surveyor)
- Proof of ownership and the cadastral reference of the plot
- The completed municipal forms plus proof of payment of the Tasa (fee)
- Depending on the location, additional reports, for example on landscape integration in rural areas
The legal basis is the Balearic urban planning law, Ley 12/2017 de urbanismo de las Illes Balears. How long the municipality takes to process the application depends heavily on the town hall: in small municipalities the licence can be ready after three to four months, while in Palma or in municipalities with many applications, six to twelve months is not unusual.
Warning: building without a permit does not pay off
A pool without a licence is a real risk on Mallorca. Municipalities systematically analyze aerial photographs, and an illegal pool can mean fines, a demolition order, or problems when you later sell the property. In protected rural areas, legalizing a pool after the fact is often not possible at all.
Stricter rules on rural land
If your plot is on Suelo Rústico, meaning outside the designated building zones, considerably tighter limits have applied since the Balearic regional planning law of 2020. Decreto-ley 9/2020 of May 25, 2020 limits new pools on rural land to a maximum of 35 m² of water surface and 60 m³ of volume. In addition:
- Only one pool is allowed per plot
- The pool must belong to a legally built house and be located close to it
- The project must blend into the landscape, for example in its materials and colors
For comparison: a classic private pool of 8 by 4 meters has 32 m² of water surface and stays just under the limit. Large pools of 10 by 5 meters or more can no longer be approved as new builds on rural land. On regular building land in residential areas these maximum sizes do not apply; there, the municipality's zoning plan determines how much of the plot may be sealed.
Boundary distances, safety, and equipment
Besides the size, the municipality also checks the position on the plot. Most zoning plans require a minimum distance to the property boundary, often 3 meters; some municipalities accept less if the neighbour agrees in writing. When it comes to safety, private pools have more freedom than public ones: fencing is usually not mandatory for purely private use. As soon as you rent the property out to tourists, however, stricter requirements apply, for example regarding safety measures and signage. A cover or a slatted roller cover is worth it twice over either way: it noticeably reduces evaporation in summer and keeps the water clean for longer. Given Mallorca's scarce water reserves, that is more than a convenience. During dry spells, some municipalities have already restricted the filling of pools.
What does a pool cost on Mallorca?
The price range is wide and depends on the construction method, size, accessibility of the plot, and equipment. As a rough guide for a pool of around 8 by 4 meters:

The concrete pool is the classic on Mallorca: freely shapeable, long-lasting, and value-stable, but the most expensive and with the longest construction time. Prefabricated fiberglass shells are cheaper and quick to install, but they need good access for the crane and are limited in shape and size. Stainless steel is the premium option with very low maintenance, but price-wise it plays in a league of its own.
The permit line item consists mainly of the ICIO, the tax on construction work, which in most municipalities lies between 2 and 4 percent of the construction sum, plus the town hall's processing fees. Tip: always price quotes with the permit included
Reputable pool builders on Mallorca handle the licence process themselves or work with a fixed architect partner. Ask for the quote to state whether the project, licence fees, and ICIO are included. A conspicuously cheap quote without these items often ends up costing more.
Do not forget the ongoing costs
Once the pool is finished, the costs really begin. Pool service, chemicals, electricity for the pump, and top-up water add up to roughly 1,500 to 3,000 EUR a year for an average private pool. Also remember to have the new pool registered in the cadastre after the final inspection. This raises the property tax (IBI) a little, but it is mandatory and saves you arguments when you later sell.
Does an above-ground pool also need a permit?
Small, removable above-ground pools without a fixed installation are permit-free in many municipalities or only require a simple notification. But as soon as digging, concreting, or fixed plumbing is involved, a building licence is required. When in doubt, ask your municipality in writing beforehand.
How long does it take from application to finished pool?
On Mallorca, 6 to 18 months in total is realistic: three to twelve months for the licence depending on the municipality, then two to ten weeks of construction depending on the method. If you want to swim in summer, submit the application the year before.
