Empadronamiento Without a Rental Contract: How to Register on Mallorca

You have been staying in your sister's spare room in Son Ferriol for three weeks, you have no rental contract of your own, and you urgently need a certificate from the town hall anyway. Registering for the empadronamiento without a rental contract is not a special case or a grey area - it is explicitly provided for in the Interior Ministry's own rules. Instead of a contract, the person who owns or rents the home signs an Autorizacion, and that settles the matter for the municipality. If you live in someone else's home, you submit a written Autorizacion from the owner or main tenant instead of a rental contract, along with a copy of that person's ID and proof that they own or rent the property. Palma and Calvia both offer their own downloadable forms for this.
The Autorizacion is the legal substitute for a rental contract
An Autorizacion de empadronamiento is the written consent of the person who owns or rents a home, allowing someone else to register at that address with the local Padron. It replaces the rental contract as proof that you actually live there.
This is set out in the Resolucion of 17 February 2020 on keeping the municipal Padron. Section 3.1 is fairly clear: if someone wants to register at an address where other people are already registered, the municipality does not ask them for their own housing document, but for the written permission of an adult who is registered there and can show that they own or rent the property.
There is an important sentence right after that in the same rule: the municipality is not allowed to use the housing proof to rule on ownership or tenancy rights. It only serves as evidence that you live there. A clerk who tells you there is no Padron without your own contract is going against their own department's instructions - which is exactly why it is worth keeping the text from the BOE on your phone.
The Padron reflects where someone actually sleeps. That is why caravans, shelters, and even people without a fixed address can be registered, as long as the municipality can reach them at a postal address.
Palma: form, ID copy and proof from the person who holds the home
The Palma town hall covers this case as a separate column in its empadronamiento information sheet (February 2026 version). If you are neither the owner nor the main tenant, you bring three things.
Completed authorisation form
Signed by the person named in the Escritura or the rental contract. Download it from the Ayuntamiento website.
Copy of their ID document
DNI, NIE card, or passport of the person signing.
Your own proof from them about the home
Escritura, Nota simple from the land registry, or the latest IBI bill if they own it. If they rent it themselves, then the rental contract for at least six months plus a payment receipt.
On top of that comes the Hoja de inscripcion padronal, signed by everyone being registered who is over 18. From the Escritura, Palma only wants to see three pages: the cover page, the page naming seller and buyer, and the page describing the property.
Appointments run through 010 or the town hall's website. Without a Cita previa you can only get in if you are over 65, in which case mornings at the OAC Son Moix work without booking. You can get an urgent appointment if you can show that a deadline of under 30 days is running, for example for a school application or the Bono social. Without proof of urgency, the request will not be processed.
Heads-up: allow up to three months processing time
Palma's information sheet states a maximum period of three months from application and reserves the right to inspect the address. If you need the certificate for an appointment, do not expect to walk out with it the same day.
Calvia and Manacor: a shorter form, same logic
Calvia offers an authorisation form as a PDF that both owners and main tenants can fill in. It asks for the address, the cadastral reference, and, for tenants, the start and end dates of the contract. Required attachments are a stamped copy of the Escritura or the original rental contract with the latest rent receipt, plus a copy of the signing person's ID.
One line on the form is easy to miss: the person who holds the home ticks whether the registered person may also request Padron certificates on their own. Tick the wrong box, and you will be back at the counter later even though you are already registered.
In Manacor, the Padron runs through the Seu Electronica and requires identification via Cl@ve or a digital certificate to access. The municipality does not publish a downloadable authorisation form, but the principle is the same. Call 971 84 91 00 beforehand and ask for the template before you make the trip.
Tip: a digital certificate saves you a second trip
Palma also accepts the application electronically, but only from the person submitting it, and only with a digital certificate or electronic ID. Applying on someone else's behalf online is not possible. If you already have other paperwork coming up, getting the certificate early is worth it.
What the person who holds the home actually risks
The most common blocker is not the town hall, but the landlord or friend who is reluctant to sign. Usually it comes from a worry about taking on some kind of liability.
The legal picture here is straightforward. Registration does not create a tenancy or a right of residence - it is a statistical and administrative entry, nothing more. There is only one real offence: if the person who holds the home consents to registering a foreign national even though the home is not actually that person's real place of residence, that is a serious breach under Article 53.2 d) of the Foreigners' Act LO 4/2000. Fines range from EUR 501 to EUR 10,000, counted per wrongly registered person.
So the real distinction is not "with or without a contract", but "actually lives there or does not". If you genuinely sleep in the home, you are not putting the person who signs at any risk. A favour registration for someone who actually lives elsewhere is a different matter.
Can the owner withdraw the Autorizacion later?
They can inform the town hall that the person has moved out. The town hall then opens a procedure to deregister the person on its own initiative and checks the address. A simple withdrawal does not delete the entry automatically.
Why you should not wait until you have your own contract
The empadronamiento sits underneath almost everything that comes after it. The health card, a school place for your kids, exchanging a driving licence, and residencia all require it. If you wait until you finally have a place of your own, you often lose months - and precisely the months during which registration deadlines are running.

But for EU citizens applying for residencia on Mallorca, offices regularly ask for a current Padron extract. Does a holiday rental count as a registration address?
Yes, if you genuinely live there most of the time and the owner signs. The Padron asks about your actual residence, not about the property's tourist licence.
Conclusion
Registering without a rental contract is standard procedure, not a favour you have to beg for. You need the signature of the person who holds the home, their ID copy, and their own proof of the property - in Palma, on top of that, the official form and an appointment. If someone at the counter tells you otherwise, pointing to Section 3.1 of the February 2020 Resolucion helps. And if the person who holds the home hesitates: as long as you actually live there, they are not signing anything that will come back to bite them.
