Professional Liability Insurance for Autonomos on Mallorca: When Is It Mandatory?

Whether you need professional liability insurance as an autonomo on Mallorca depends on your profession, not your turnover. Doctors, lawyers, gas and electrical installers, and operators of leisure facilities are legally required to carry a seguro de responsabilidad civil. Web designers, translators, and consultants face no such requirement, even if an insurance agent tells you otherwise. This post sorts out which cover you actually need, which one is optional, and why your home country policy usually stops working once you move.
At a glance
Professional liability insurance is a legal requirement in Spain only for certain regulated professions, such as doctors, lawyers, and registered installation companies. For most other autonomos it is optional, but often worth having. Tradespeople registered with the Balearic industry authority also have to prove a specific minimum coverage amount.
Professional liability insurance covers damage you cause to a third party in the course of your professional work, for example a water leak after an installation job or a piece of advice that leads to a financial loss for the client. It differs from general personal liability insurance in that it covers professional risks only.
Is Professional Liability Insurance Mandatory for Autonomos in Spain?
There is no blanket insurance requirement for self-employed people in Spain. The obligation only kicks in through a specific professional regulation: a law, a decree, or the statutes of a professional association that explicitly requires a seguro de responsabilidad civil profesional for certain activities. This includes medical staff, lawyers, the transport sector, and operators of leisure facilities. If your profession belongs to a chamber or a colegio profesional, for example architects or real estate agents with API registration, the best move is to check directly with that body whether insurance is a condition for registration, and at what level.
For every other activity, professional liability insurance stays optional. That does not make it unnecessary: a graphic designer who accidentally uses a copyrighted image, or a coach whose advice leads to a financial loss for a client, is still liable with their personal assets. You can read more about the basics of self-employment in our Autonomo guide. When in doubt, your gestoria or professional association can tell you whether a requirement applies to your specific activity.
Mandatory Insurance for Installers in the Balearics
It gets a lot more concrete for tradespeople registered with the Balearic industry authority. Anyone registering as an empresa instaladora for electrical, gas, air conditioning, or fire protection systems must prove professional liability cover with a set minimum amount, according to the Balearic industry administration's requirements. The amounts vary by category: at least 600,000 euros per claim for low-voltage installations, at least 1,000,000 euros for high-voltage systems, between 300,000 and 900,000 euros for gas installations depending on the category, and 800,000 euros for fire protection systems. Without this proof, the registration stays incomplete, and without registration you cannot legally invoice for certain installation work in the Balearics at all.
Check your registration status before taking on work
If you install electrical, gas, or air conditioning systems as a tradesperson, check your registration status with the Conselleria d'Indústria before accepting any jobs. A missing professional liability policy is not a minor detail there, it blocks your registration as an empresa instaladora outright.
This requirement does not only apply to people starting out. If you have been working as an autonomo for a while and expand into a new installation category, for example an electrician who now also installs home EV chargers, you often need a separate coverage amount for that new category.
General Liability Insurance Instead of or In Addition to Professional Liability
Professional liability and general liability insurance are often confused, but they cover different risks. Professional liability kicks in for mistakes in your professional service, such as bad advice or a faulty installation. General liability covers broader risks from running your business, for example a customer tripping in your shop or a supplier getting hurt in your workshop. For autonomos with their own premises or walk-in customers, such as hairdressers, physiotherapists, or small workshops, general liability insurance is usually the more useful addition to your professional cover.
The following questions can help you decide what extra cover you need on top of any legal requirement:
- Do you have customers visiting your own premises, or do you work entirely remotely?
- Does your work risk causing property damage at a client's site, for example through installations or transport?
- Do you advise on matters with financial consequences for the client, such as taxes, law, or finance?
- Do you store or use expensive tools or materials that would need replacing after a break-in or fire?
Sick Pay: When Illness Becomes a Loss of Income
As an autonomo, you are covered for treatment costs through the public health system as soon as you pay your cuota. Income during a longer illness is a different story: the statutory sick pay from the Seguridad Social is based on the contribution base you chose, and for many autonomos it falls well short of actual lost earnings, especially in the first weeks of an illness. We cover the calculation and the role of your mutua colaboradora in detail in Sick as an Autonomo: what the mutua and sick pay cover. The Tesoreria General de la Seguridad Social has general information on benefits and responsibilities.
If you do not want to carry the gap between statutory sick pay and your actual income on your own, you can close it with a private income protection policy. These policies pay an agreed daily rate regardless of what the Seguridad Social covers.
Contents Insurance for Your Office, Practice, or Workshop
If you store tools, equipment, or stock at a fixed location, theft or water damage can cost you more than a liability claim from a third party ever would. Contents insurance, seguro de continente y contenido in Spanish, covers exactly this kind of damage to your own business property. For a hair salon with expensive equipment or a workshop full of machinery, it is often just as important as liability cover, only it protects your side of the damage instead of someone else's.
Do I need professional liability insurance as a web designer or translator? Not by law. These professions are not subject to any registration or chamber requirement that includes insurance. A voluntary policy can still make sense if contracts with larger clients require proof of liability cover.
Your home country professional liability policy usually ends once you deregister there, or it simply does not cover risks in Spain in the first place, since most policies limit their scope to your home country or the EU without local specifics. Check this directly with your insurer before relying on your existing policy.
Conclusion
Professional liability insurance is only mandatory for autonomos on Mallorca if your profession falls under a legal regulation, for example medical professions, lawyers, or registered installation companies. Tradespeople registered with the Balearic industry authority must prove specific minimum coverage amounts, from 300,000 euros for smaller gas installations up to 1,000,000 euros for high-voltage systems. For every other autonomo, the decision stays voluntary and depends on how much liability risk your daily work actually carries. Check your specific case with your chamber or gestoria before taking out a policy, or deciding to go without one.
