Autonomo Regularizacion: Back Payment or Refund

If you work as an autonomo on Mallorca, you may already have received a letter from the Seguridad Social that caught you off guard: a regularizacion of your contributions for a year you thought was long settled. Since the contribution base was tied to your actual net income, the Tesoreria General de la Seguridad Social reconciles every year what you paid against what you actually owed according to your Renta. For 2024 income, this reconciliation ran from January to April 2026 through the NOTESS electronic mailbox. Income from 2025 should be due for its turn from January 2027, following the usual schedule.

Since the reform of autonomo contributions, the Seguridad Social compares your actual annual income against the contribution base you chose. The result is either neutral, a refund, or a back payment with a fixed deadline. If you overpaid, you can keep the higher base for your pension; if you owe a back payment, a surcharge of 10 or 20 percent applies if you miss the deadline. You can challenge the notice with a recurso de alzada within one month.
What Is the Autonomo Contribution Regularizacion?
The regularizacion is the annual reconciliation between the contribution base an autonomo chose during the year and their actual net income according to the tax return. If the two figures do not match, the Seguridad Social refunds or claims back the difference.
Since 2023, as an autonomo you no longer pay a freely chosen flat rate, but a contribution bracket based on your estimated net income. Because hardly anyone knows their exact annual income in January, the TGSS only corrects this afterward, once the Renta is filed. For 2024, according to calculations by the independent fiscal watchdog AIReF, this brought in roughly 250 million euros in additional revenue for the social security funds, because more autonomos had to pay back than got money returned. The Three Possible Outcomes
The notice the TGSS sends you lands on one of three outcomes:
- Neutral: your income matches the chosen base, and nothing changes.
- Refund: you paid more than your income required, and you get the difference back.
- Back payment: your income was higher than the chosen base, and you have to pay the difference.
The Seguridad Social pays out refunds by 30 April without you having to apply for anything. With a back payment, on the other hand, it is up to you to take action.
Deadlines and What Happens With a Back Payment
The deadline for responding to a back payment is short: you have until the last day of the month following delivery of the notice to pay. If you receive the notice on, say, 10 February, the deadline runs out on 31 March. If you pay later, the Seguridad Social charges a surcharge of 10 or 20 percent, depending on how overdue the payment is.
Keep an Eye on Your NOTESS Mailbox
The regularizacion notice arrives electronically through NOTESS. If you do not check your mailbox within 10 calendar days, the notice still counts as delivered, and the payment deadline keeps running.

Keeping a Higher Base for Your Pension
If you voluntarily paid a higher base than your income required since December 2022, the regularizacion offers you an option: you can keep the higher base for your pension calculation instead of getting the difference refunded. You have to make this decision by the same deadline as paying a back payment, meaning before the last day of the following month.
Tip: Keep Your Pension in Mind
If you are only a few years from retirement, the higher base often benefits you more than the refund. Weigh the amount against its effect on your pension calculation base for recent years before deciding.

Appealing With a Recurso de Alzada
If you disagree with the notice, for example because the TGSS used the wrong income figure, you can file a recurso de alzada within one month of delivery. The administrative procedure law Ley 39/2015 sets this one-month deadline for appeals against administrative decisions in general. File the appeal electronically through the same Sede the notice came from, and attach the documents that show your actual income, such as your already-filed Renta or a correction of it.
Have your Renta documents and the annual certificate of your contribution payments ready before the deadline even starts. A gestoria who knows your bookkeeping can often tell within a few minutes whether the notice matches your actual income, and that is especially worthwhile if you want to file an appeal.
What happens if I miss the appeal deadline? The notice becomes final, and the back payment stands, even if the calculation was wrong. A later correction is then only possible through a separate procedure and is significantly more involved.
Conclusion
The regularizacion is now a fixed part of the autonomo year: the Seguridad Social compares your income with the base you paid and sends you a refund or back payment notice through NOTESS. What matters is the deadline - the last day of the following month - whether you need to pay or want to keep the higher base for your pension.
