Valor de Referencia: Check and Challenge the Reference Value

If you buy, inherit or receive a property on Mallorca as a gift, your tax has long stopped being based on the purchase price. What counts is the Valor de Referencia, the reference value of the Spanish cadastre. If your purchase price is below it, the tax office still calculates on the higher value and sends you a demand for the difference later. This post shows you where to look up the value for your property, how realistic it is on Mallorca and which steps let you challenge it.
At a glance
Since 2022 the Valor de Referencia has been the minimum taxable base for transfer tax (ITP) and inheritance tax (ISD). You can look it up free of charge in the Sede Electrónica del Catastro. You cannot challenge it directly, only through a correction of your tax return or an appeal against the tax assessment. For that you need an appraisal, and you have four years.
The Valor de Referencia is an official value that the Dirección General del Catastro sets every year for every property in Spain. It is derived from the sale prices recorded by notaries in the relevant valuation zone. Unlike the cadastral value (Valor Catastral), it is not used for the annual property tax but as the minimum taxable base for transfer tax and for inheritance and gift tax.

Where to look up the Valor de Referencia
The query is free and takes a few minutes. All you need is the cadastral reference (Referencia Catastral) of the property, which appears on every IBI bill and in the escritura.
Open the Sede Electrónica del Catastro
On sedecatastro.gob.es, open the "Valor de referencia" section. To simply view the value you do not need a digital ID.
Enter the Referencia Catastral
Enter the 20-digit cadastral reference or search for the property by address and municipality.
Select the year
The value always applies to one calendar year. What counts is the year of the notary appointment or the death, not the year of the tax return.
Request the certificado if you want to challenge
With Cl@ve or a digital certificate you additionally receive an official certificate with the reasoning behind the value. You need it for any appeal.
The values for 2026 were set by resolution of the Dirección General del Catastro of October 27, 2025 and announced in the Boletín Oficial del Estado of December 16, 2025. They have been available since January 1, 2026. For this year the cadastre created 349 new valuation zones, in which values have shifted noticeably in places.
Why the reference value is often off on Mallorca
The reference value reflects the average of a zone, not the condition of your specific property. On Mallorca this is especially visible, because a renovated villa and a finca without power and water connections can sit in the same valuation zone. Typical reasons for an inflated valuation:
- The property is unrenovated while the zone is shaped by new builds and renovations
- Structural defects such as damp, settlement cracks or a broken roof are not factored in
- The cadastral data is wrong, for example living area, year of construction or type of use
- Rural plots without building permission are treated like serviced building plots
- The property is rented out or encumbered with a usufruct and therefore harder to sell
Watch out: a lower purchase price does not protect you
If you buy a property below the reference value, the reference value remains the taxable base. The Balearic tax authority ATIB automatically cross-checks purchase contracts against the cadastral data and assesses the difference, often only one or two years after the notary appointment. Always calculate the tax on the higher of the two values.
A real-world example shows the effect: you buy an apartment for 380,000 EUR, and the Valor de Referencia is 430,000 EUR. Transfer tax in the Balearics is tiered and starts at 8 percent, so the 50,000 EUR difference costs around 4,000 EUR in additional tax. How to challenge the Valor de Referencia
You cannot file an isolated objection against the value itself. The cadastre's official anuncio says so explicitly: anyone who feels disadvantaged must either request a correction of their own tax return or challenge the tax assessment. So there are two routes.
Route 1: rectificación de la autoliquidación. You first pay based on the reference value and then request a correction of your self-assessment plus a refund. This is the usual route for a purchase, because you declare the tax yourself.
Route 2: recurso de reposición or reclamación económico-administrativa. If the administration sends you an assessment, for example a supplementary demand, you file an appeal within one month or go directly to the Tribunal Económico Administrativo Regional.
In both cases the tax administration obtains a binding report from the cadastre. Without solid counter-evidence, the reference value stands. What you need:
- An appraisal (tasación) by a licensed valuer, dated to the notary appointment
- Photos and evidence of defects, renovation backlog or usage restrictions
- Comparable sales from the immediate neighbourhood, if available
- For data errors: a request to correct the cadastral data itself
Tip: use the four-year window
You have four years to request a correction of the self-assessment and a refund of overpaid tax. So you do not have to decide on the day of the notary appointment whether the effort is worth it. An appraisal on Mallorca usually costs 300 to 600 EUR, which pays off from a value difference of roughly 20,000 EUR.
Important for expectations: the Spanish Constitutional Court upheld the system on February 12, 2026 with ruling STC 13/2026. The reference value therefore stays valid. But the court explicitly stressed that it can be rebutted if you prove it does not reflect the market value. A well-founded appraisal remains the decisive lever.
What applies to inheritance and gifts
For inheritances and gifts the same mechanism applies: the reference value is the minimum taxable base for inheritance and gift tax under law 29/1987. This hits heirs on Mallorca twice, because unlike a buyer they cannot negotiate the value, and the tax return is due within six months of the date of death.
In practice: check the Valor de Referencia right after the death, not shortly before the deadline. If it is clearly too high, commission the appraisal immediately so it matches the reference date. Does the Valor de Referencia also apply to the IBI property tax?
No. The IBI is still calculated from the Valor Catastral, a different and usually much lower value. The two values exist side by side and are maintained separately.
What happens if I buy above the reference value?
Then the price actually paid is the taxable base. For tax purposes, the higher of the two values always counts, never the lower.
Can I look up the value before buying?
Yes, the query is public and not tied to ownership. Check the value before signing the arras contract, then you can bring it into the price negotiation.

The Valor de Referencia is the silent side calculation in every property transaction on Mallorca. Check it before the notary appointment, not after: five minutes in the cadastre portal can spare you a demand with interest. If the value is clearly above the real market value of your property, a challenge is possible, but it only works with a solid appraisal and via the detour of the tax return.
