If you live on Mallorca in 2026 and smoke, you need to pay closer attention than just a few years ago. Smoking on Mallorca in 2026 is no longer just about smoky indoor spaces: it now covers beaches, bar and restaurant terraces and many public areas. In the Balearics the rules were first tightened at municipal level, and in July 2026 the Spanish government set a new anti-tobacco law in motion that goes even further. This post tells you as a resident where you can no longer smoke today, what is about to change and what fines are realistic.

Where smoking bans apply on Mallorca in 2026
A smoking ban on Mallorca is a prohibition, set by national law or municipal ordinance, on consuming tobacco or e-cigarettes in certain places. In 2026 it mainly covers enclosed public spaces, many designated beaches and, increasingly, outdoor areas such as bus stops and playgrounds.
There is currently no island-wide smoking ban on beaches. Instead, each municipality decides which stretches of beach go smoke-free. According to the Balearic administration, around 50 beaches in the Balearics are currently smoke-free, more than 30 of them on Mallorca alone. The number grows every season as more town halls follow suit. On these beaches, signs and blue markings on the ground indicate the smoke-free zone.

The new anti-tobacco law: terraces and public spaces
On July 21, 2026, the Spanish council of ministers approved the draft of a stricter anti-tobacco law. That is an important step, but not yet applicable law: the draft still has to pass parliament and be published in the official gazette (BOE) before it takes effect. Until then, the current rules apply.
The draft plans to extend the smoking ban considerably, among other places to:
- Bar and restaurant terraces
- Beaches and public swimming pools
- Sports facilities and universities
- Open-air events and festivals
- A 15-meter radius around the entrances of hospitals, schools and other public buildings
Another new element: e-cigarettes and vapes are to be treated legally the same as classic tobacco. If the law passes in this form, the terrace disappears as the last refuge for smokers in hospitality. Watch out: not yet in force
The stricter law is so far only a government draft. A smoking ban on a specific terrace applies only once the law has been published in the BOE or the municipality has passed its own ordinance. When in doubt, follow the signage on site.
Fines: what smoking in the wrong place costs
The level of fines is set by the Spanish tobacco law (Ley 28/2005) and the municipal beach ordinances. Smoking in a prohibited place normally counts as a minor infraction. Worth knowing: the often-quoted maximum of 600,000 euros applies to serious violations by manufacturers and sellers, not to an individual smoker on the beach.

In practice, municipalities usually impose amounts at the lower end on individual smokers on a smoke-free beach. Still: checks by the local police or the Guardia Civil del Mar are not unusual on popular beaches, and the fine can be issued on the spot.
Practical tips for smokers and non-smokers
As a resident you will get through this relaxed if you keep a few simple points in mind:
- On the beach, watch for blue ground markings and signs saying "Platja sense fum" or "Playa sin humo".
- Use the ashtrays provided or a pocket ashtray; cigarette butts in the sand are a separate finable offense.
- When in doubt, ask the staff at a bar whether smoking is allowed on the terrace instead of assuming it.

Can I smoke on a restaurant terrace on Mallorca in 2026?
Yes, as long as no municipal ordinance forbids it and the new national law is not yet in force. Once the anti-tobacco law appears in the BOE, smoking on hospitality terraces is banned. Until then, the signage on site decides.
